Terms and information for consumers

This is a translation. In case of discrepancy, the German version governs, because the contract is concluded under Austrian law and in German. This does not affect the mandatory protections of the law of the country where you are habitually resident.
These terms apply if you are a consumer within the meaning of § 1 KSchG, that is, you are not contracting in the course of your business. They prevail over the terms for businesses where the two conflict.
The paid services are aimed primarily at businesses. As a consumer you will usually purchase the site report as a one-off.
§ 1 Provider
The provider is AS4 Holding GmbH, Reklewskigasse 19A/2, 1230 Wien, VAT ID ATU82919512, reachable at office@ladeindex.com. The details in the imprint govern.
§ 2 Prices
All prices shown to consumers are total prices including value added tax. No additional costs arise; no shipping costs apply to digital content.
§ 3 Conclusion of contract
The contract is concluded when you complete the order using the button “order with obligation to pay” and we confirm it. Before you submit, you are shown the scope of services, the total price and these terms.
§ 4 Right of withdrawal
You may withdraw from this contract within 14 days without giving any reason.
The period is 14 days from the day the contract was concluded.
To exercise your right of withdrawal you must inform us by a clear statement (for example by e-mail to office@ladeindex.com). You may use the model form below, but you do not have to. To meet the deadline it is sufficient to send your statement before the period expires.
Effects of withdrawal
We will refund all payments received without delay, at the latest within 14 days of the day your statement reaches us. We will use the same means of payment you used for the original transaction; you will not incur any fees for this.
Early loss of the right where delivery starts immediately
Important: for digital content not supplied on a physical medium — which includes the site report as a PDF — your right of withdrawal lapses under § 18(1)(11) FAGG if
- you have expressly requested that we begin performance before the withdrawal period expires,
- you have confirmed that you thereby lose your right of withdrawal, and
- we have provided you with confirmation of that agreement.
We obtain that confirmation expressly before the purchase and document it. If you do not give it, your right of withdrawal remains; delivery then takes place after the 14 days have passed, or on your later request.

§ 5 Ongoing contracts and cancellation
If you conclude an ongoing contract, you may cancel it at any time with effect from the end of the current billing period. A button is provided in the customer portal — no phone call, no reason, no form.
§ 6 Warranty
The statutory warranty applies. The provisions of the Consumer Warranty Act and the Austrian Civil Code remain unaffected; the limitations in § 12 of the terms for businesses do not apply to you.
§ 7 Dispute resolution
The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr
We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration body. This does not affect your statutory rights; you may go to court at any time.
§ 8 Choice of law and jurisdiction
Austrian law applies. This choice does not deprive you of the protection of mandatory provisions of the country in which you are habitually resident. For jurisdiction, § 14 KSchG applies: you may be sued only at your domicile, habitual residence or place of employment.
§ 9 What stays the same for you
For consumers too: all published figures are statistical estimates with a confidence interval and an expiry date. What that means is set out in § 2 of the terms for businesses and in detail on the methodology page. A figure without its interval and its expiry date is a different statement from the one made — which is why both appear everywhere, including in your report.
